This website and MyCatholicDoctor Academy is operated by MyCatholicDoctor MSO, Inc., a Connecticut-based nationwide healthcare management services organization ("MyCatholicDoctor MSO," "we," "us," or "our"). MyCatholicDoctor Academy is the online health education platform of MyCatholicDoctor MSO, Inc. Throughout these Terms, the terms "we," "us," and "our" refer to MyCatholicDoctor MSO, Inc.

MyCatholicDoctor MSO, Inc. offers this website, including all courses, educational materials, information, tools, and Services (defined below) available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.

By visiting our site and/or purchasing or enrolling in any course or Service, you engage in our "Services" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, learners, purchasers, course creators, and contributors of content.

Please read these Terms carefully before accessing or using our Services. By accessing our Services or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to the Terms, you may not access the website or use our Services.

Any new features or tools added to the current website are subject to these Terms of Service. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes your acceptance of those changes.

SECTION 1 — EDUCATIONAL PURPOSE AND MEDICAL DISCLAIMER

MyCatholicDoctor Academy provides online health education courses, materials, and resources designed to support learning about health, medicine, and wellness from a Catholic perspective. All content available through MyCatholicDoctor Academy — including but not limited to course videos, written materials, downloadable resources, discussion forums, assessments, and instructor communications — is intended solely for general educational and informational purposes.

THE CONTENT PROVIDED THROUGH MYCATHOLICDOCTOR ACADEMY IS NOT INTENDED TO CONSTITUTE, AND SHOULD NOT BE USED AS A SUBSTITUTE FOR, PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Nothing in any Academy course, lesson, resource, discussion, or communication from an instructor or the Academy should be construed as:

(a) establishing a physician-patient, therapist-patient, counselor-client, or any other professional healthcare relationship between you and MyCatholicDoctor MSO, Inc. or any course instructor;

(b) providing individualized medical advice, diagnosis, or treatment recommendations for any specific person or condition;

(c) replacing consultation with a qualified, licensed healthcare professional regarding your individual health needs;

(d) constituting theological or pastoral counseling; or

(e) serving as a basis for any specific medical, clinical, or life decision without independent professional consultation.

Always seek the advice of your physician, nurse practitioner, or other qualified health professional with any questions you may have regarding a medical condition, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or learned in an Academy course or resource. If you believe you are experiencing a medical emergency, contact emergency services immediately.

Course instructors on MyCatholicDoctor Academy are independent contractors who present educational content within their professional areas of expertise. Their participation as Academy instructors does not constitute the provision of healthcare services, and communications through the Academy platform do not create a clinical care relationship.

MyCatholicDoctor MSO, Inc. is not responsible for any actions taken or not taken based on information provided through Academy courses or materials, or for any consequences of reliance on such information.

SECTION 2 — WEBSITE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site under your supervision.

You may not use our Services for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction in connection with your use of the Services (including but not limited to copyright laws).

You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of the Terms will result in immediate termination of your access to Services.

SECTION 3 — GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

With the exception of credit card and payment information, which is always encrypted during transfer over networks, you understand that your content may be transferred unencrypted and may involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, any course content, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

SECTION 4 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

MyCatholicDoctor MSO, Inc. endeavors to ensure that all course content published on MyCatholicDoctor Academy meets its quality standards for medical accuracy and theological fidelity at the time of publication. However, medical knowledge evolves, and content may become outdated. We are not responsible for any errors or omissions, or for results obtained from the use of information provided through Academy courses or materials.

The material on this site is provided for general educational purposes only and should not be relied upon as the sole basis for making healthcare decisions. Any reliance on course content for clinical or personal health decisions is at your own risk, and you are encouraged to consult qualified healthcare professionals.

We reserve the right to modify, update, or remove content on this site at any time without notice.

SECTION 5 — MODIFICATIONS TO SERVICES AND PRICING

Prices for courses and Services are subject to change without notice. We reserve the right to modify or discontinue any Service or course (or any part or content thereof) without notice at any time.

We will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 6 — COURSES AND ENROLLMENTS

Certain courses or Services may be available exclusively online through the Academy website. Course availability is subject to change. Unless otherwise stated, all sales are final (see also Section 22 — No Refund Policy).

We reserve the right to limit course enrollment, restrict access to specific geographic regions, or discontinue any course at any time. Any offer for any course or Service made on this site is void where prohibited.

We do not warrant that any course will meet your specific professional development, certification, or continuing education requirements. Learners are responsible for verifying that any course meets applicable requirements before enrolling.

SECTION 7 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order or enrollment you submit. You agree to provide current, complete, and accurate purchase and account information for all transactions made on our site. You agree to promptly update your account information, including your email address and payment details, so that we can complete transactions and contact you as needed.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY INTEGRATIONS

We may provide you with access to third-party tools and integrations — including our course delivery platform, payment processors, and communication services — over which we neither monitor nor have any control or input beyond the terms of our agreements with those providers. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind. We shall have no liability arising from or relating to your use of optional third-party tools.

MyCatholicDoctor Academy is delivered through Thinkific, a third-party learning management system. Your use of the Thinkific platform is also subject to Thinkific's terms of service.

SECTION 9 — THIRD-PARTY LINKS

Certain content or resources available through our Services may include links to third-party websites. Third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining, evaluating, or warranting the content, accuracy, or practices of any third-party website. We are not liable for any harm or damages related to the use of any third-party resources or websites accessed through our Services.

SECTION 10 — USER COMMENTS, FEEDBACK, AND COURSE DISCUSSIONS

If you choose to provide feedback, ideas, suggestions, questions, answers, or other comments related to our Services or courses ("Feedback"), we may use such Feedback without restriction or obligation to you, and you hereby waive any claim to ownership or compensation therefor.

With respect to course discussion forums, community features, and any communications within the Academy platform:

(a) You are solely responsible for the accuracy and appropriateness of any content you post.

(b) Discussion content is not a substitute for professional medical or pastoral advice.

(c) We may, but are not obligated to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, inaccurate, harmful, or otherwise objectionable.

(d) You agree that your comments and posts will not violate the rights of any third party, including intellectual property, privacy, or personality rights.

(e) You may not use the Academy platform to provide individualized medical advice, make clinical recommendations to other users, or engage in the unauthorized practice of medicine or any licensed profession.

SECTION 11 — PERSONAL INFORMATION AND PRIVACY

Your submission of personal information through MyCatholicDoctor Academy is governed by our Privacy Policy. To view our Privacy Policy, please see: https://academy.mycatholicdoctor.com/pages/privacy

MyCatholicDoctor MSO, Inc. complies with applicable federal and state privacy laws. For questions about how your personal health information is handled, please contact [email protected].

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions related to course descriptions, pricing, availability, or other content. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

SECTION 13 — PROHIBITED USES

In addition to other prohibitions set forth in these Terms of Service, you are prohibited from using our Services:

(a) for any unlawful purpose or in violation of any applicable laws or regulations;

(b) to infringe, violate, or misappropriate any intellectual property, confidentiality, or privacy rights of any person;

(c) to transmit, post, or distribute content that is harmful, fraudulent, deceptive, misleading, threatening, harassing, defamatory, obscene, or otherwise objectionable;

(d) to attempt to obtain another user's account credentials or security information;

(e) to violate the security of any computer network or circumvent any security measures;

(f) to submit false or misleading information;

(g) to reproduce, sell, resell, or exploit any portion of the Academy's courses or content without express written authorization;

(h) to use any robot, spider, or automated process to monitor or copy content from the Service without prior written consent;

(i) to provide individualized medical, clinical, therapeutic, or pastoral advice to other users through discussion forums, community features, or any other Academy platform feature;

(j) to represent Academy course content as constituting a professional medical consultation or clinical care relationship; or

(k) to engage in any use that, in our sole discretion, may harm MyCatholicDoctor MSO, Inc., its reputation, its learners, or its mission.

We reserve the right to terminate your access to the Service for violating any of the prohibited uses.

SECTION 14 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that course content will be current, accurate, or complete at all times, or that the content will meet your specific educational, professional, or clinical needs.

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON COURSE CONTENT FOR HEALTH INFORMATION OR EDUCATIONAL PURPOSES, IS AT YOUR SOLE RISK. THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

In no event shall MyCatholicDoctor MSO, Inc., its directors, officers, employees, affiliates, agents, contractors, course instructors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service, reliance on any course content for personal or clinical decisions, or any other claim related to your use of the Service.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability in such jurisdictions shall be limited to the maximum extent permitted by law.

SECTION 15 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MyCatholicDoctor MSO, Inc. and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms of Service, your violation of any law or the rights of any third party, or your use of any Academy course content in a manner inconsistent with these Terms, including any reliance on such content for individual medical or clinical decisions.

SECTION 16 — SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service without affecting the validity and enforceability of any other remaining provisions.

SECTION 17 — TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services or by ceasing use of our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part thereof.

SECTION 18 — ENTIRE AGREEMENT

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and MyCatholicDoctor MSO, Inc. and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.

The failure of us to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of such right or provision.

SECTION 19 — GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.

SECTION 20 — CHANGES TO TERMS OF SERVICE
